Changes in the purpose of processing and data use
Since the processing methods used may change/evolve due to technical advances and organizational changes, we reserve the right to further develop this data protection declaration in accordance with the new technical framework conditions. We therefore ask you to review the data protection declaration from time to time. If you do not agree with the further developments that occur over time, you can request in writing, in accordance with Art. 17 EU GDPR, that the data that is not stored on the basis of other legal requirements, such as commercial or tax law retention obligations, be deleted.
Anonymous data collection
In principle, you can visit the websites of the responsible body without telling us who you are. We only learn the name of your Internet service provider, the website from which you visit us, and the websites you visit on our site. This information is evaluated for statistical purposes. You remain anonymous as an individual user.
Purpose of data collection
The personal data you enter in our form will be used exclusively for the purposes of advice, support and individual training planning. This includes querying your training goals, health data and other relevant information that is necessary to create a personalized training plan.
Your data will be processed on the basis of your express consent in accordance with Art. 6 Paragraph 1 Letter a of GDPR. You can revoke your consent at any time with effect for the future.
Your data will only be stored for as long as is necessary to carry out the training or to fulfill legal obligations. Your data will then be deleted.
Your data will not be passed on to third parties without your express consent, unless this is necessary to fulfill the contract or permitted by law.
We use technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorized access by third parties.
Collection and processing of personal data
Personal data is only collected if you provide it to us voluntarily, for example for the purpose of carrying out a contractual relationship between us, as the responsible body, and the visitor, as the data subject. The responsible body adheres to the requirements of Art. 5 and 6 of the EU GDPR. As part of the personalized services of the responsible body, your registration data will be processed, subject to your consent, for the purpose of sending you our newsletter or to tailor the electronic services offered to your needs. You have the option of objecting to the storage of your personal data at any time. To do so, please send an email to kontakt@day1-coaching.de with the subject “Unsubscribe from data records”.
Your personal data will be processed and used in accordance with the provisions of the BDSG or, from May 25, 2018, the EU GDPR. Export and processing of data to countries outside the European Economic Area Your personal data will not be exported to countries outside the European Economic Area (hereinafter EEA). Nevertheless, if you are logged into Facebook or have a Twitter or Instagram account, personal data may be exported to the USA. For further explanations and options for preventing this data export, please read the section “Use of Facebook Social Plugins” or “Use of Twitter” or “Use of Instagram Social Plugins” in this data protection declaration. However, personal data will not be transmitted to Google as part of the use of analysis programs by the responsible body, as your IP address will only be transmitted anonymously. Please read the section “Use of analysis programs” in this data protection declaration. If you are logged in to Google or have a YouTube account, personal data can be exported to the USA. For further explanations and options for preventing this data export, please see the section “Use of YouTube plug-ins”. The service providers engaged by the responsible body are based and operate their IT infrastructure exclusively within the EEA. This also applies to any use of cloud-based services. Contracts exist with the service providers that comply with the data protection and data security requirements of the European Data Protection Directive (95/46/EC) and German data protection law, or, as of May 25, 2018, the EU GDPR. Even if external service providers are engaged, BD remains the body responsible for processing. Use and disclosure of personal data The personal data collected on the responsible body’s websites will only be used to process the contract and process your inquiries without your consent. In addition, your data will only be used for advertising and market research purposes by the responsible body if you have given your prior consent. Otherwise, no data will be passed on to other third parties. You can of course revoke your consent at any time with effect for the future.
External Links
For your information, you will find links on our website that refer to third-party websites. If this is not obvious, we would like to point out that this is an external link. The responsible body has no influence on the content and design of these websites of other providers. The guarantees of this data protection declaration therefore do not apply to external providers.
Use of cookies
The responsible body uses so-called “cookies” to individually design and optimize the customer’s online experience and online time. A cookie is a text file that is either temporarily stored in the computer’s memory (“session cookie”) or saved on the hard disk (“permanent” cookie). Cookies contain, for example, information about the user’s previous accesses to the corresponding server or information about which offers have been accessed so far. Cookies are not used to run programs or to load viruses onto your computer. The main purpose of cookies is rather to provide an offer that is specifically tailored to the customer and to make using the service as convenient as possible. The responsible body uses session cookies and permanent cookies.
Session cookies
The responsible body primarily uses “session cookies”, which are not stored on the customer’s hard drive and are deleted when the browser is closed. Session cookies are used for login authentication and load balancing (balancing the system load).
Persistent cookies
In addition, the responsible body uses “permanent cookies” to save the personal usage settings that a customer enters when using the responsible body’s services, and thus to be able to personalize and improve the service. The permanent cookies ensure that the customer finds his personal settings again when he visits the responsible body’s websites again. In addition, the service providers that the responsible body has commissioned to analyze user behavior use permanent cookies in order to be able to recognize returning users. These services only save the data transmitted by the cookie anonymously. An assignment to the customer’s IP address is not maintained.
Avoiding cookies
The visitor has the option to refuse the use of cookies at any time. This is usually done by selecting the corresponding option in the browser settings or by using additional programs. More details can be found in the help function of the browser used by the customer. If the customer decides to deactivate cookies, this can reduce the scope of the service and have a negative impact on the use of the services of the responsible party.
We use the consent tool “Real Cookie Banner” to manage the cookies and similar technologies used (tracking pixels, web beacons, etc.) and the related consents. You can find details on how “Real Cookie Banner” works here.
The legal basis for the processing of personal data in this context is Art. 6 Para. 1 lit. c GDPR and Art. 6 Para. 1 lit. f GDPR. Our legitimate interest is the management of the cookies and similar technologies used and the related consents.
The provision of personal data is neither contractually required nor necessary for the conclusion of a contract. You are not obliged to provide the personal data. If you do not provide the personal data, we will not be able to manage your consents.
